BUYER and/or USER assumes all responsibility for any damage resulting from the use or misuse of these products.

To the maximum extent permitted by applicable law, BUYER hereby waives all claims against SELLER arising from the use of these products and waives all remedies or liabilities, expressed or implied, arising by law or otherwise (including without limitation any obligations of SELLER with respect to fitness, merchantability, and consequential damages), whether or not occasioned by SELLER's negligence. SELLER expressly disclaims any liability for personal injury or damages. BUYER acknowledges that this disclaimer is a material term of this agreement and agrees to indemnify SELLER and hold SELLER harmless from all claims related to or arising from installation and/or use of the product purchased. It is BUYER's responsibility to ensure proper installation and use.

By purchasing any product through this website, BUYER acknowledges and agrees:

1. It is the responsibility of the BUYER to ensure all USERS of products purchased comply with all local, state, and federal laws regarding vehicle equipment, emissions, noise/sound, and speed/use.
2. Installation and use of these products could result in the voiding of vehicle and/or parts manufacturers' warranties.
3. BUYER is not relying upon SELLER's skill or judgment to select or furnish products suitable for any particular purpose, and all products are sold without any warranty whatsoever, express or implied, as to fitness for any particular intended use.

All notices from Motor City K5 to you may be posted on this website and will be deemed delivered within thirty (30) days after posting. Notices from you to Motor City K5 shall be made either by email to Mark@MotorCityK5.com or by first class mail to: 11261 Buno Road, Brighton, MI 48114. Delivery shall be deemed to have been made by you five (5) days after the date sent.

All brand, product, service, and process names appearing on this website are trademarks of their respective holders. We accept major credit and debit cards, including Visa, Mastercard, American Express, and Discover, processed securely through our third-party payment processor. By providing your card information and completing a purchase, you authorize Motor City K5 and our payment processor to charge the full order amount, including applicable taxes, shipping, and fees disclosed at checkout. You represent that you are the authorized cardholder or have the cardholder's permission to use the card.

All card transactions are processed through a PCI DSS–compliant payment processor using industry-standard encryption. We do not store your full card number, CVV, or expiration date on our servers.

If your card is declined or a transaction fails, your order will not be processed. You are responsible for providing a valid payment method. We are not liable for any fees your card issuer may charge in connection with declined or failed transactions.

All transactions are processed in U.S. Dollars (USD). For international orders, currency conversion rates and any conversion fees are determined by your card issuer and are not controlled by Motor City K5.

We may update these Terms from time to time to reflect changes in our payment processing, legal requirements, or business practices. The version posted at the time of your transaction governs that transaction.
